1. Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of The Swing Desk ("we," "us," "our"), including this website (theswingdesk.com) and the private Telegram community offered through it (the "Service"). By checking the consent box on our Pricing page, completing a purchase, or otherwise accessing the Service, you agree to these Terms. If you do not agree, do not purchase or use the Service.
2. About the Service
The Swing Desk is a private, paid Telegram community operated by the team behind the free "Swing Trading" public channel. Access is sold in one-time, fixed-duration tiers (30, 90, or 180 days) — there are no subscriptions and no automatic renewals. The Service consists of general market education: commentary on market structure, chart patterns, and technical and fundamental concepts. It does not include specific entry, target, or stop-loss calls, and nothing delivered through the Service is personalized investment advice. See Section 9 below.
3. Eligibility
You must be at least 18 years old to purchase or use the Service. By purchasing, you represent that you meet this requirement and that your use of the Service does not violate any law or regulation applicable to you in your jurisdiction, including any restriction on receiving financial education content or on your ability to trade the markets discussed. You are solely responsible for determining whether use of the Service is lawful where you are located.
4. Access and Payment
Each tier is a single, one-time payment processed through Stripe — we do not store your card details. Access to the private Telegram channel is provisioned after payment through a short automated flow: you complete checkout, follow the on-screen instructions to open our Telegram bot, and request to join the private channel, which is then approved automatically. Your access period (30, 90, or 180 days depending on the tier purchased) begins when your join request is approved and access is activated, not on the date payment is made — this protects you if there is a delay between paying and completing the join step. If you purchase again while an existing access period is still active, the new period is added on top of your remaining time rather than restarting from zero.
5. Immediate Access and Waiver of Withdrawal Right
The Service is digital content and a digital community delivered electronically, not a physical good. By completing your purchase, you expressly request that we begin providing you access immediately, rather than waiting out any statutory waiting period. To the fullest extent permitted by applicable law, you acknowledge and agree that once immediate access has begun being provided to you, you expressly waive any otherwise-applicable statutory right of withdrawal, cancellation, or "cooling-off" period for digital content or services not supplied on a tangible medium (including, where applicable, rights of the kind described in the EU Consumer Rights Directive and equivalent national implementing laws). This waiver is a condition of receiving immediate access and is separate from, and in addition to, the no-refund terms in Section 6 and our Refund Policy.
6. No Refunds
Once access to the private channel has been granted, your purchase is final and non-refundable, regardless of whether you use the access, how much of the period you use, or your reasons for wanting to cancel. This applies equally to all tiers. Full details, including how billing errors are handled, are set out in our Refund Policy, which forms part of these Terms.
7. Consent and Acceptance Records
Before you are redirected to checkout, our Pricing page requires you to affirmatively check a box confirming you have read and agree to these Terms and our Refund Policy. We record the timestamp, the IP address the request was made from, and the version of these Terms in effect at that moment, and retain that record as evidence of your acceptance.
8. Community Conduct
Access to the private channel is personal to you and may not be shared, resold, or transferred. Content shared inside the Service is for your personal use only and may not be redistributed, screenshotted for redistribution, or republished elsewhere without our permission. We may remove any member who violates this section, engages in harassment, solicits other members, or otherwise disrupts the community, without refund.
9. No Financial Advice
Everything provided through the Service — on this website and inside the private channel — is general market education for informational purposes only. It is not personalized investment, legal, or tax advice, and it is not a recommendation to buy, sell, or hold any financial instrument. We do not provide specific entry, target, or stop-loss calls. Trading and investing carry a substantial risk of loss and are not suitable for everyone. You are solely responsible for your own trading and investment decisions. Always do your own research and consider consulting a licensed, qualified financial advisor before acting on anything discussed in the Service.
10. Third-Party Services
Checkout is processed by Stripe, and access is delivered through Telegram's bot and channel platform; hosting and infrastructure run on Cloudflare. Your use of Telegram and Stripe is separately governed by each provider's own terms of service and privacy policy, which we do not control. We are not responsible for outages, account restrictions, or policy changes on those third-party platforms.
11. Intellectual Property
All content delivered through the Service — analysis, educational material, graphics, and the "ST" mark — is owned by or licensed to us and is provided for your personal, non-commercial use only. No license is granted to reproduce, resell, or distribute it.
12. Termination
We may suspend or remove your access if you violate these Terms, if your payment is reversed through a chargeback or dispute, or if a refund is issued to you for any reason — access removal in these cases does not entitle you to any refund of the amount already paid or a refund of any unused period. Your access will also end automatically at the expiry of the period you purchased unless you buy an additional period beforehand.
13. Disclaimer of Warranties; Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee any particular trading outcome, uninterrupted availability, or that the Service will meet your expectations. To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you actually paid us for the access period giving rise to the claim.
14. Governing Law and Disputes
If you have a dispute, please contact us first at [email protected] so we can try to resolve it informally. These Terms are intended to be enforced to the maximum extent permitted under the mandatory consumer-protection laws that apply to you in your place of residence, and nothing in these Terms limits any statutory right that cannot lawfully be waived.
15. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date and version number at the top of this page will change accordingly. If a change is material, we may ask returning purchasers to re-confirm consent before further purchases. Continued use of the Service after an update constitutes acceptance of the revised Terms.
